Article 41 Other agricultural areas 1 - Without prejudice to the legislation in force on the National Ecological Reserve, in other agricultural areas, the Municipal Council may authorise: a) the building, provided that it is located in a legally constituted rustic building with an area greater than 5 000 m2 and if justified in terms of improvement of agricultural work; b) the residential building, provided that it is located in a legally constituted rustic building with a minimum area equal to or greater than 4 ha and if it is justified in terms of improvement of agricultural work. 2 - The buildings referred to in paragraph 1 shall be subject to the following conditions: a) Gross construction index: 0.06; b) Maximum floor area: 400 m2, including housing, up to 200 m2, and construction must be concentrated; Regulation of the Municipal Master Plan of Alcobaça – compiled version 17 c) Maximum height of constructions, with the exception of silos, water tanks or special technically justifiable installations: 6.5 m and two floors. 3 - The buildings referred to in paragraph 1 shall have the water supply and drainage of sewage ensured by an autonomous system, the construction and maintenance of which shall be the responsibility of the interested parties, unless they finance the extension of the public networks. 4 - The impossibility or inconvenience of implementing individual solutions for infrastructures in these areas may be grounds for making construction unfeasible. 5 - When there is the presence of surrounding constructions within a radius of no more than 50 m from the implantation of the building and the land is Served by paved roads and public water and electricity networks, the municipal executive may allow construction on plots of less than 5,000 m2, but never less than 3,000 m2, provided that they are not intended for housing. 6 - Restoration works may be authorised, alteration or expansion of a building, provided that the existing architectural and constructive characteristics are maintained and do not involve an increase in the gross construction area of more than 40%, not exceeding the values indicated in paragraph b) of paragraph 2 of this article. 7 - In these areas, the City Council shall allow agricultural and livestock facilities, tourist enterprises classified as housing tourism enterprises, rural tourism enterprises, camping and caravanning parks, rural hotels or similar hotel catering and beverage facilities, isolated industrial and storage facilities, and the following conditions must be respected: 7.1 - Agricultural and livestock facilities. - Without prejudice to the ongoing process of legalization of agricultural and livestock farming, according to the register of the Municipality of Alcobaça, the new units to be installed will comply with the following requirements: a) Minimum area of plot already constituted: 20000 m2; (b) maximum gross construction index: 0.05; c) Effluents from agricultural or nitreira installations may not be discharged directly into water lines, and their bacteriological and chemical treatment must be ensured beforehand, and the release of any effluents containing polluting substances directly into the aquifers through gullies is not permitted; sinks and other inputs characteristic of the karst model; d) Maximum height: 4.5 m and one floor; e) Distance from the boundaries of the plot: 20 m; f) Distance from defined urban perimeters and other agricultural areas: 200 m; (g) Maximum number of herds to be reared: 50 pigs/ha or equivalent. 7.2 - Tourist resorts classified as residential tourism resorts, rural tourism resorts, camping and caravan parks, rural hotels or similar hotel catering and beverage facilities: a) Minimum plot area: 10 000 m2, that it will require a single tourist enterprise; b) Maximum number of floors: three; c) Parking: one car for every two rooms; (d) construction should be concentrated; e) 75% of the total area of the plot should be made up of green areas, preserving the existing tree species. 7.3 - Isolated industrial installations and storage. - Without prejudice to the provisions of the legislation in force, the City Council may authorize the construction of isolated industries and storage in plots that constitute a matrix or cadastral unit of a size equal to or greater than the minimum unit of culture, subject to the following conditions: a) Deployment index, including annexes: 0.20; b) The areas intended for support facilities may increase the useful area resulting from the application of the implantation index to the plot, and may not exceed 5% of the parcel area; Regulation of the Municipal Master Plan of Alcobaça – compiled version 18 c) The maximum percentage of impermeable soil, including expansion area, traffic routes, parking lots, deposits of raw materials, finished products and waste, may not exceed 30% of the total surface of the plot; d) The maximum height of any building body may not exceed a plane of 45º, defined from any of the limits of the plot, with a maximum of 6.5 m; e) The distance of buildings from the limits of the parcel adjoining the public road shall be 20 m, without prejudice to the observance of the non aedificandi zones prescribed for the national road network; f) The parking area is established in the proportion of one place per 150 m2 of gross industrial construction area; g) In the protection strips between the industrial buildings resulting from the provisions of subparagraphs c), d) and e) of this paragraph and the boundaries of the plot, only low constructions, such as entrances or transformer stations, may be authorized, always respecting a minimum distance of 5 m from the latter constructions in relation to the building. the said limits of the parcel; b) a edificação para habitação desde que esta se localize em prédio rústico legalmente constituído com área mínima igual ou superior a 4 ha e se se justificar em termos de melhoria de trabalho agrícola. 2 - As edificações referidas no n.º 1 ficarão sujeitas aos seguintes condicionamentos: a) Índice de construção bruto: 0,06; b) Superfície máxima de pavimento: 400 m2, incluindo habitação, até 200 m2, devendo a construção ser concentrada; regulamento do plano diretor municipal de alcobaça – versão compilada 17 c) Cércea máxima das construções, com excepção de silos, depósitos de água ou instalações especiais tecnicamente justificáveis: 6,5 m e dois pisos. 3 - As edificações referidas no n.º 1 terão o abastecimento de água e a drenagem de esgotos assegurados por sistema autónomo cuja construção e manutenção serão a cargo dos interessados, a menos que estes financiem a extensão das redes públicas. 4 - A impossibilidade ou a inconveniência da execução nestas áreas de soluções individuais para as infra-estruturas poderão ser motivo de inviabilização de construção. 5 - Quando se verificar a presença de construções envolventes num raio não superior a 50 m da implantação de edificação e o terreno for servido por via pavimentada e redes públicas de água e electricidade, poderá o executivo municipal permitir a construção em parcelas inferiores a 5 000 m2, mas nunca inferiores a 3000 m2, desde que as mesmas não se destinem a habitação. 6 - Podem ser autorizadas obras de recuperação, alteração ou ampliação de edificação desde que sejam mantidas as características arquitectónicas e construtivas existentes e não envolvam um aumento da área bruta de construção superior a 40%, não ultrapassando os valores indicados na alínea b) do n.º 2 do presente artigo. 7 - Nestas áreas a Câmara Municipal permitirá instalações agro-pecuárias, empreendimentos turísticos classificados como empreendimentos de turismo de habitação, empreendimentos de turismo no espaço rural, parques de campismo e caravanismo, hotéis rurais ou instalações de restauração e bebidas similares de hotelaria, instalações industriais isoladas e de armazenagem, devendo ser respeitados os seguintes condicionamentos: 7.1 - Instalações agro-pecuárias. - Sem prejuízo do processo de legalização de agro-pecuárias em curso, de acordo com o cadastro da Câmara Municipal de Alcobaça, as novas unidades a instalar obedecerão às seguintes prescrições: a) Área mínima de parcela já constituída: 20000 m2; b) Índice de construção bruto máximo: 0,05; c) Os efluentes de instalações agro-pecuárias ou nitreiras não podem ser lançados directamente em linhas de água, devendo ser previamente assegurado o seu tratamento bacteriológico e químico, não sendo permitida a libertação de quaisquer efluentes que contenham substâncias poluidoras directamente nos aquíferos através de algares, sumidouros e outras entradas características do modelo cársico; d) Cércea máxima: 4,5 m e um piso; e) Afastamento aos limites da parcela: 20 m; f) Afastamento aos perímetros urbanos definidos e a outras agro-pecuárias: 200 m; g) Número máximo de efectivos a criar: 50 suínos/ha ou equivalente. 7.2 - Empreendimentos turísticos classificados como empreendimentos de turismo de habitação, empreendimentos de turismo no espaço rural, parques de campismo e caravanismo, hotéis rurais ou instalações de restauração e bebidas similares de hotelaria: a) Área mínima da parcela: 10 000 m2, que obrigará a um único empreendimento turístico; b) Número máximo de pisos: três; c) Estacionamento: um carro para cada dois quartos; d) A construção deverá ser concentrada; e) 75% da área total da parcela deverão ser constituídos por zonas verdes, preservando-se as espécies arbóreas existentes. 7.3 - Instalações industriais isoladas e armazenagem. - Sem prejuízo do disposto na legislação em vigor, a Câmara Municipal poderá autorizar a edificação de indústrias isoladas e armazenagem em parcelas que constituam uma unidade matricial ou cadastral de dimensão igual ou superior à unidade mínima de cultura, com sujeição aos seguintes condicionamentos: a) Índice de implantação, incluindo anexos: 0,20; b) As áreas destinadas a instalações de apoio poderão acrescer a superfície útil resultante da aplicação do índice de implantação à parcela, não podendo ultrapassar, em conjunto, 5% da superfície da mesma; regulamento do plano diretor municipal de alcobaça – versão compilada 18 c) A percentagem máxima de solo impermeabilizado, incluindo área de expansão, vias de circulação, parques de estacionamento, depósitos de matérias-primas, produtos acabados e desperdícios, não pode ultrapassar 30% da superfície total da parcela; d) A altura máxima de qualquer corpo de edificação não poderá ultrapassar um plano de 45º, definido a partir de qualquer dos limites da parcela, com o máximo de 6,5 m; e) O afastamento das edificações aos limites de parcela confinante com a via pública será de 20 m, sem prejuízo da observância das zonas non aedificandi prescritas para a rede rodoviária nacional; f) A área de parqueamento é estabelecida na proporção de um lugar por 150 m2 de área bruta de construção industrial; g) Nas faixas de protecção entre os edifícios industriais resultantes do disposto nas alíneas c), d) e e) deste número e os limites da parcela apenas poderão ser autorizadas construções baixas, tais como portarias ou postos de transformação, respeitando-se sempre um afastamento mínimo de 5 m destas últimas construções em relação aos referidos limites da parcela;
